These General Terms and Conditions apply to the ordering, sale, delivery and related rights and obligations concerning the products and associated services available in the Evolution Speed Skating online store at https://www.evolutionspeedskating.com

2. Scope and Acceptance of the Terms and Conditions

These General Terms and Conditions govern contracts concluded between the Service Provider and any natural person, legal entity or organisation without legal personality using the online store. A consumer is a natural person acting outside the scope of their profession, self-employed occupation or business activity. By finalising an order, the customer declares that they have read, understood and accepted these General Terms and Conditions and the Privacy Notice as binding upon them.

3. Products and Services Available for Purchase

The online store offers speed skating, short track and long track speed skating, inline speed skating equipment, boots, blades, inline skating parts, protective equipment, sharpening and maintenance tools, apparel and training accessories, as well as related technical services. The essential characteristics, purchase price, stock information and any specific conditions of the products are set out on the relevant product page.

4. Order Process and Formation of the Contract

  • The customer selects the product, chooses the required size, type or other variant where applicable, and places it in the cart.
  • After reviewing the cart, the customer provides billing and delivery details and selects the payment and delivery method.
  • Before submitting the order, the customer may review and correct the data entered.
  • Clicking the “Submit Order” button or any equivalent button constitutes an offer involving a payment obligation.
  • The Service Provider sends an automatic order confirmation by e-mail. The contract is concluded when the Service Provider accepts the order in a separate e-mail or starts performance.

5. Prices, Payment and Invoicing

Prices displayed in the online store may be shown in euros or Hungarian forints and include value added tax where VAT is applicable under the relevant legislation. Delivery charges, any cash-on-delivery fee or other costs are displayed during the order process before the order is finalised.

Payment may be made by bank card through Stripe, or by bank transfer.

The Service Provider issues an invoice in accordance with the applicable accounting and tax rules and sends it attached to the e-mail confirming fulfilment of the order.

6. Delivery and Performance

The Service Provider delivers the ordered products to the address provided by the customer and may also offer personal collection or showroom collection. The expected delivery time depends on product availability, the destination country and the selected delivery method. The Service Provider informs the customer by e-mail when the product has been dispatched or is available for collection. Upon receipt, the customer must inspect the integrity of the package and, in the event of damage, request a damage report from the carrier.

7. Right of Withdrawal for Consumers

Under Government Decree 45/2014 (26 February), the consumer may withdraw from the contract without giving any reason within 14 calendar days from receipt of the product. In the case of an order involving several products, the withdrawal period starts on the day on which the last product is received. The consumer may exercise the right of withdrawal by making an unequivocal statement by e-mail, by post or via the withdrawal interface provided in the online store.

In the event of withdrawal, the Service Provider refunds all amounts paid by the consumer, including the standard delivery charge, no later than 14 days from becoming aware of the withdrawal. The Service Provider may withhold the refund until the consumer has returned the product or has provided credible evidence that the product has been returned. The direct cost of returning the product is borne by the consumer, unless the Service Provider provides otherwise.

8. Exceptions to the Right of Withdrawal

The consumer does not have a right of withdrawal in respect of non-prefabricated products produced on the basis of the consumer’s instructions or express request, or products that are clearly personalised for the consumer. This may include, for example, sports equipment that is individually sized, modified, customised, sharpened, assembled or set up specifically according to the customer’s requirements, provided that the statutory conditions are met. The right of withdrawal may also be excluded for sealed products that cannot be returned for health protection or hygiene reasons if the consumer has opened the packaging.

9. Implied Warranty, Product Warranty and Commercial Guarantee

In the event of defective performance, the customer is entitled to implied warranty rights under the Hungarian Civil Code. In the case of a consumer contract, the consumer may enforce implied warranty claims within two years from performance. The consumer may request repair or replacement, unless this is impossible or would involve disproportionate additional costs; failing this, the consumer may request a price reduction, have the defect repaired at the Service Provider’s expense, or withdraw from the contract.

In the case of the sale of movable goods between a consumer and a business, the consumer is also entitled to product warranty rights, under which the consumer may request the manufacturer or distributor to repair or replace the defective product. Certain durable consumer goods may be subject to mandatory warranty under the legislation in force from time to time. The duration and conditions of the warranty may depend on the nature and purchase price of the relevant product, of which the Service Provider informs the customer at the time of purchase.

10. Complaint Handling and Enforcement of Rights

The customer may submit a complaint in writing to shop@evolutionspeedskating.com, by post to the registered office of the Service Provider, or by telephone during customer service hours. The Service Provider examines and remedies verbal complaints immediately where possible; written complaints are answered on the merits within no later than 30 days. If a complaint is rejected, the Service Provider informs the consumer of the available remedies.

The consumer may apply to the conciliation board competent according to their place of residence or stay. The Service Provider cooperates in conciliation board proceedings. The consumer may also submit a complaint to the consumer protection authority and may enforce their rights before the courts. In the case of a dispute relating to an online sales contract, the consumer may also use the European Commission’s online dispute resolution platform.

11. Data Processing

The Service Provider processes customers’ personal data for the purposes of fulfilling orders, invoicing, customer service, complaint handling, compliance with legal obligations and the enforcement of legitimate interests. The detailed rules of data processing are set out in the Privacy Notice available on the website. The customer is required to provide true, accurate and complete data; the Service Provider is not liable for any damage arising from missing or inaccurate data.

12. Liability and Force Majeure

The Service Provider endeavours to ensure that the information displayed in the online store is accurate and up to date, while reserving the right to modify prices, stock information, product descriptions and service terms. In the event of an obviously incorrect price or technical error, the Service Provider is not obliged to perform under the erroneous terms but may offer to conclude the contract under the correct terms or cancel the order. The Service Provider is not liable for any delay or damage caused by circumstances beyond its control that were unforeseeable and unavoidable.

13. Applicable Legislation

These General Terms and Conditions are governed in particular by Act V of 2013 on the Hungarian Civil Code, Act CVIII of 2001 on electronic commerce services, Government Decree 45/2014 (26 February) on the detailed rules of contracts between consumers and businesses, Act CLV of 1997 on consumer protection, and the rules on mandatory warranty applicable to certain durable consumer goods.

14. Final Provisions

The Service Provider is entitled to amend these General Terms and Conditions unilaterally. Any amendment enters into force upon publication on the website and applies to orders placed after the effective date. Contracts already concluded are governed by the General Terms and Conditions in force at the time of the order. If any provision of these General Terms and Conditions is invalid or unenforceable, this does not affect the validity of the remaining provisions.
